What everyone asks before registering
Frequently asked questions about trademarks, patents, INPI deadlines and costs.
What is the difference between a Trademark Registration and a Patent?
A registered trademark is a symbol that identifies a product or distinguishes a service. A patent, on the other hand, can be an invention or something involving a more innovative concept.
Can individuals register a trademark?
Yes. You do not need a company registration (CNPJ) to register a trademark. The main difference is the fee: individuals pay a reduced fee, as do micro and small businesses.
What does it cost to lose a trademark?
Besides causing stress, hurting the company’s image and driving customers away, losing a trademark is also expensive! Costs are estimated at 10 to 100 times what the registration would have cost.
That means losing all the investment already made in your trademark, for example: logo, business cards, website, uniforms, signage, changes to the articles of association, etc.
Does a CNPJ protect my trademark?
A CNPJ does not guarantee trademark registration! That’s right, don’t confuse the two!
Many people starting out in business believe the CNPJ is the trademark itself, or at least protects it, but unfortunately that is not true.
The CNPJ is the legal entity! It is the legal registration of your company’s identity only at the state commercial registry, not of your trademark.
In Brazil, trademarks are registered with a single body, INPI.
Can I register my trademark with the logo?
Yes! In the same application you can register the name (word mark) and the logo (figurative mark). The registration cost stays the same.
How long does INPI registration take?
INPI’s examination is the longest stage of the process. The current timeline is added here from INPI’s official source, updated by the team. While the application is pending, you can already use the trademark with the filed application and follow every movement in the client area.
How long does a registered trademark last?
Ten years from the grant, renewable for equal periods for as long as the trademark makes sense for your business. Regicenter warns you before the renewal deadline.
