Appeals

A rejected application is not the end of the road. An appeal can be filed with the INPI President within 60 days.

What you need to know

Rejections usually come from a conflict with an earlier trademark, a legal prohibition applied to the sign or an upheld opposition. In every case the decision can be reviewed: the Industrial Property Law provides for an appeal within 60 days of publication.

The appeal does not repeat the original application — it challenges the decision. The brief must attack the ground used by the examiner and bring what was not considered: differences between the signs, different audiences and channels, coexistence already practised in the market, evidence of use. An appeal is also how a trademark is defended when third parties appeal against its grant.
