Cease-and-desist notices

Misuse of your trademark by third parties starts being solved with a notice — before it turns into a lawsuit.

What you need to know

With the registration in hand, you have the exclusive right to use the trademark throughout Brazil. When another company uses the same name on a storefront, packaging, ad, social media profile or marketplace store, the cease-and-desist notice formalises the demand to stop the use and records the date the infringer was warned.

In most cases the notice solves it without litigation: the use stops, the profile is changed, the ad comes down. When it does not, the notice becomes evidence of bad faith in a lawsuit or in a takedown request to platforms and marketplaces.
