What you need to know

An idea cannot be patented: what is patented is the technical solution described. An invention patent requires novelty, inventive step, industrial application and sufficient disclosure; a utility model protects a new form or arrangement that brings a functional improvement to an object of practical use. Disclosing before filing compromises novelty — the grace period under Brazilian law is 12 months, and many countries do not recognise it.

The application is built with a specification, claims, drawings and an abstract. The wording of the claims defines what the patent really protects, and it is the part that most decides the outcome of the examination. An invention patent lasts 20 years and a utility model 15, counted from filing.
