INPI classes: where your trademark is protected

Registration does not protect a name in a vacuum: it protects it within classes of goods and services, following the Nice Classification. Choosing the right classes is what decides whether the registration covers what your business really does.

A restaurant that also sells bottled sauces, for example, lives in two different classes. The responsible unit maps this with you before the application, because adding a class later means a new application.

Classes that come up most often
    25 Clothing, footwear and headwear
30 Coffee, bakery, sweets and prepared foods
35 Retail, advertising and business management
    41 Education, training and entertainment
43 Restaurants, coffee shops and accommodation
The full list has 45 classes. The final choice depends on the activity described in your CNPJ and on how the trademark is actually used.

Questions from those starting their registration

About costs: the INPI fee is reduced for individuals, MEIs, micro and small businesses. The unit states the total cost in writing before any application.
Do I need to wait for registration to use the trademark?
No. You can keep using it during the process. What the filed application does is secure your priority: from that point on, you have a date to claim the name.
What if someone opposes my application?
An opposition is not a rejection. You have a deadline to respond, and the response is prepared by Regicenter as part of following the process.
Should I register the name, the logo or both?
In the same application you can register the name (word mark) and the logo (figurative mark), as a composite mark. The registration cost stays the same.
Is the registration valid outside Brazil?
INPI registration protects within Brazil. For other countries, Regicenter handles international applications through treaties such as the Madrid Protocol, MERCOSUR, PCT, BENELUX and the European Union.
