Oppositions
Someone applied at INPI for a trademark similar to yours. An opposition is the way to block that application before registration.
What you need to know
Every trademark application is published in the Industrial Property Journal (RPI) and stays open to opposition for 60 days. It is the window in which the owner of an earlier trademark — or an earlier application — can point out the conflict and ask INPI to refuse the new filing. Once the date passes, only the longer route of administrative nullity remains.
Regicenter monitors the publications for the trademarks it manages, warns you when a conflicting application appears and prepares the opposition with evidence of priority and use. On the other side, when the opposition is against your application, the defence is made through a response.
How it works
Monitoring finds the conflicting application as soon as it is published.
The unit compares signs, classes and audiences and tells you whether the opposition holds up.
The brief is filed within the 60 days, with evidence of your priority.
INPI decides and publishes. The third party’s application may be refused or go on to appeal.
