Defences and responses

When someone opposes your application or INPI raises a requirement, the response has a deadline and a form. That is what we prepare.

What you need to know

Between filing and grant, the application may receive oppositions from third parties or formal and technical requirements from INPI. Ignoring any of them costs the application: without a response, the examination proceeds with only the other party’s version, and a requirement not met on time archives the application.

The unit prepares the response with the arguments of your case: absence of conflict, coexistence in the market, proven prior use, adjustment of the specification or correction of documents. Each brief is filed within the deadline published in the Industrial Property Journal.

What Regicenter does
Reading of the opposition or requirement and its legal grounds
Gathering of evidence of use and priority
Drafting and filing of the response on time
Follow-up of the decision in the Industrial Property Journal

How it works

Step 1 of 4
Alert

Monitoring identifies the publication and warns you with the deadline already counted.

Step 2 of 4
Strategy

The team analyses what was alleged and defines the line of defence and the evidence needed.

Step 3 of 4
Filing

The response is filed at INPI within the legal deadline, with a copy for you.

Step 4 of 4
Decision

The result is published in the RPI and explained in plain language, with the next steps.

Process handled by the unit in your region. Deadlines and fees follow INPI’s official publications.
